BIOGRAPHY
For over 15 years, Daniel Brast has represented San Diego real estate developers and general contractors in complex construction-related disputes and handled transactional matters for a variety of companies, ranging from small local businesses to Fortune 500 giants. Daniel gained valuable insight into the real estate and construction industries by working in-house for a multinational insurance company, focusing primarily on complex construction-related claims. In addition, he is a licensed California real estate broker, which also gives him particular insights into the needs of his real estate and construction clients.
His general business transactional work includes drafting and reviewing contracts, corporate formation documents, cease and desist letters, nondisclosure agreements, trademark applications, commercial leases, and confidentiality agreements for various types of businesses. As part of his practice, he also advises and represents small businesses in the craft brewery and craft beverage industries.
He has successfully settled multi-million-dollar claims involving both residential and commercial condominium complexes, resolved claims related to soils movement, differential settlement and landsides involving both residential and commercial construction, and obtained a complete defense by prevailing on motions for judgment on pleadings and motions for summary judgment. Daniel has also successfully resolved claims related to failure to disclose conditions in real estate transactions.
Daniel is known as a savvy problem solver and a strong advocate. While he has considerable complex litigation experience, he is able to assist clients in transactional matters and help them minimize some of risks that often lead to litigation. He puts the best interests of his clients first and aims to work as cost-effectively and efficiently as possible.
After earning a Bachelor of Arts degree from California Polytechnic State University (San Luis Obispo), Daniel earned his law degree from California Western School of Law. While he was in law school, Daniel worked for the California Innocence Project, investigating and drafting appellate briefs in support of claims of wrongful conviction and factual innocence by prisoners in California.
